Waiting for a Title Deed in Cyprus: How Buyers Stay Protected Until It Issues

Thousands of properties in Cyprus are sold before a separate title deed exists for them: new builds where deeds have not yet issued, older units in developments where the division was never completed, and auction properties sold as contractual rights. These purchases can be done safely, but they are a different transaction from buying a deeded property, and they must be treated as one.

What you actually acquire

Without a separate deed, the transfer of registered ownership into your name cannot happen yet. What protects you in the meantime is your contract of sale, deposited at the Land Registry, which secures your right to specific performance: the right to compel transfer of the title when it issues. The quality of that contract, and the speed of its deposit, are therefore not paperwork details. They are the purchase.

The questions that decide the risk

Why has no deed issued? A building completed recently is one thing; a development where deeds have been pending for fifteen years is another. Is there a mortgage over the parent land, and does the bank waive its rights over your unit? Do the permits match what was actually built, since unauthorised works are a classic reason deeds never issue? And what does the seller’s own paper trail look like: is your seller the registered owner of the land, or someone who also bought by contract and is assigning rights to you?

The honest answer about timing

A realistic estimate of when a deed can issue is part of proper due diligence. Sometimes the answer is soon. Sometimes the answer is that issuance depends on the developer completing obligations it has ignored for years, and the price should reflect that.
