Property Scams and Red Flags in Cyprus

In short

Most Cyprus property transactions are honest. The problematic minority follows patterns that repeat so reliably that a buyer who knows them is very hard to catch: manufactured urgency on the reservation, the seller's lawyer offered as yours, money moving before any search. This is the list we check against.

Here is the list we check against, refined by the files that reach a lawyer only after something has gone wrong.

Pressure on the reservation

The classic opening: the price is special, another buyer is coming tomorrow, and the reservation deposit must be paid today to hold the unit. A reservation signed before any checks can commit your deposit on terms you have not read. Legitimate sellers give you days for a check. Manufactured urgency is the oldest tool in the trade.

The seller's lawyer, offered to you

You will be told it is faster and cheaper to use the developer's or seller's lawyer for everything. One lawyer cannot serve two opposing interests. The suggestion itself tells you the other side would prefer your interests unrepresented.

The missing papers

No title deed available for inspection, permits that are always about to be found, a mortgage nobody mentioned until you asked in writing. Documents that exist are produced quickly. Documents that are promised repeatedly usually do not say what you have been told they say.

The property that differs from its permits

Extra floors, converted garages, enclosed verandas, a house standing where permits show something smaller. Unauthorised works are common in Cyprus and they are not a cosmetic issue: they can block the issue of a title deed indefinitely and become your problem the day you complete.

Prices and payments that avoid the record

Any suggestion to declare a lower price, pay part in cash, or route money outside the contract creates risk that lands on you: tax exposure, a contract that understates what you paid, and a weaker position if the deal collapses.

The pattern behind all of them

Almost every item above is a way of keeping the transaction out of the register, which is why one provision does most of the protecting. The Sale of Immovable Property (Specific Performance) Law, Law 81(I)/2011, provides in section 3 that the contract is deposited at the District Lands Office within six months of the date of its signature. A seller who discourages that deposit, or who lets the six months run, is removing the single thing that would secure your position. What happens if the deadline is missed is under the six month deadline.

Every scheme on this list works by separating your money from your information. The cure is boring and completely effective: independent checks, your own lawyer, and no signature or payment until the searches are back.

Before you commit to any property in Cyprus, have it checked by Cyprus property lawyers acting for you and for nobody else in the transaction.

The document the seller owes you by law

One of these red flags now has a statutory answer, and most buyers do not know it. Since the Sale of Immovable Property (Specific Performance) (Amending) Law of 2023, section 4(1A) of Law 81(I)/2011 requires the seller to include, as an integral part of the contract, a search certificate for the property, bearing a date that differs from the date of signature by no more than five working days.

That is not a courtesy and it is not negotiable by drafting. A contract put in front of you without a current search certificate attached to it is a contract that does not comply, and the seller is the one out of compliance, not you.

Section 4(1B) supplies the consequence. Regardless of any criminal liability under the Law, where a seller fails to comply with section 4(1A) the Director may impose an administrative fine of up to EUR 10,000, after notifying the seller by registered letter of the reasons and giving them five working days to make representations.

So when you are told that the papers will turn up, the question is not whether to believe it. It is why a certificate that takes days to obtain, and that the seller is obliged to attach, is not attached.

The mortgage that appears after you sign

Section 4(1) closes the oldest trap in Cyprus conveyancing. Before mortgaging property that is the subject of a contract the buyer has not lodged, the seller has an obligation to lodge that contract under section 3, provided the buyer has performed their contractual obligations up to the date of lodging.

The proviso is the part to read twice. The seller's duty is conditional on your having kept up your side. A buyer who has fallen behind on an instalment has, without knowing it, released the seller from the obligation that was protecting them.

Questions we are asked

What document must the seller attach to the contract?

A search certificate for the property, dated no more than five working days before the date of signature. Section 4(1A) of Law 81(I)/2011, added by the 2023 amending Law, requires the seller to include it as an integral part of the contract. A contract without one does not comply, and the non-compliance is the seller's.

What happens to a seller who does not attach it?

Section 4(1B) allows the Director to impose an administrative fine of up to EUR 10,000, regardless of any criminal liability under the Law, after notifying the seller by registered letter of the reasons and allowing five working days for representations. So the absence of the certificate is not a formality anyone is entitled to wave through.

Can the seller mortgage the property after I have signed?

Not without lodging your contract first. Section 4(1) obliges the seller, before mortgaging property that is the subject of a contract the buyer has not lodged, to lodge that contract under section 3. The obligation is conditional: it applies provided the buyer has performed their contractual obligations up to the date of lodging. A buyer behind on an instalment may have released the seller from the duty that was protecting them.

Why does lodging matter so much in a scam?

Because section 5(1) provides that lodging the contract constitutes a charge over the property, taking priority from the date of lodging. Everything a dishonest seller can do to your position, they do in the window before you lodge. Section 3(1)(c) gives you six months from signature to close that window, and closing it early costs nothing.

They are pressing me to pay a reservation fee today. Should I?

It is the classic opening. A reservation signed before any checking commits your money on terms you have not read. Legitimate sellers give you days to check.

The seller has offered me their lawyer. Is that acceptable?

No. One lawyer does not serve two opposing interests, and the offer itself tells you the other side would prefer your interests to go unrepresented.

I am told the permits will turn up. Is that normal?

Documents that exist are produced quickly. Documents promised repeatedly usually do not say what you were told they say.

An email asks me to pay into a different account. What do I do?

Confirm any new payment instructions by telephone, on a number you already had, not on a number that arrived with the message.
